FORT WORTH, TX (May 15, 2025) – Today, Firearms Policy Coalition (FPC) announced that it has filed an opposition to Texas’ motion for summary judgment in its Second Amendment lawsuit challenging laws prohibiting individuals from carrying firearms at certain locations in the state.

Summary

Texas criminal law bans the carriage of firearms at certain locations, including in any business where alcohol comprises 51% or more of sales (even if the individual is not consuming alcohol); at racetracks; and at sporting events. FPC is working to eliminate these bans but the State of Texas is resisting FPC’s efforts by trying to prevent the plaintiffs from getting relief in court.

What We’re Working to Achieve

Through this case, FPC is working to achieve the including:

  • A federal court declaration that the challenged carry bans are unconstitutional.
  • An injunction blocking enforcement of the challenged carry bans.
  • The ability for peaceable people to travel to ordinary public places while armed for self-defense and other lawful purposes.
  • Elimination of unconstitutional locational restrictions throughout the United States.

Quotes

FPC’s brief says, “Texas has chosen a curious way to demonstrate alleged support for its residents’ Second Amendment protected rights. Texas claims to agree with Plaintiffs that the flat bans on carrying firearms in the everyday locations at issue here violate the Second Amendment. Yet Texas labors to conjure supposed procedural barriers to prevent this Court from writing a decision enjoining enforcement of the unconstitutional restrictions.”

FPC President Brandon Combs said, “It is disappointing that the State of Texas is using every trick in the book to keep gun owners from defeating these unconstitutional carry bans. We look forward to seeing these laws struck down so peaceable gun owners may exercise their right to bear arms in the Lone Star State without being treated like a criminal.”

Plaintiffs & Counsel

FPC is joined in the litigation by three FPC members, Charles Ziegenfuss, David Montgomery, and Brian Robinson.

The plaintiffs are represented by Bradley A. Benbrook and Stephen M. Duvernay of Benbrook Law Group, P.C., along with R. Brent Cooper of Cooper & Scully, P.C.

FPC thanks FPC Action Foundation for its strategic support of this FPC Law case.
