SAN FRANCISCO (May 29, 2024) – Today, Firearms Policy Coalition (FPC) announced that it has filed a brief in the Ninth Circuit Court of Appeals defending its trial court victory in Nguyen v. Bonta, in which a federal district court judge declared unconstitutional and enjoined California’s ‘one-gun-per-month’ gun ban law. The brief can be viewed at firearmspolicy.org/nguyen.
This lawsuit began in December 2020 when FPC filed the challenge. After extensive briefing the trial court held that California failed to meet its burden and show that the State’s ban survives the Supreme Court’s test for Second Amendment claims.
“California’s authoritarian ban on purchasing more than one firearm at a time is blatantly unconstitutional. Just as the State could not prohibit you from buying more than one book at a time, it cannot prohibit you from buying more than one gun at a time. Any honest reading of the Second Amendment’s text and application of binding Supreme Court precedent will confirm that this insane law must be enjoined,” said FPC President Brandon Combs.
“Once again, FPC’s brief demonstrates why California’s unconstitutional gun ban law cannot survive. The Second Amendment protects the right of the people to keep and bear arms. That right cannot be limited as California does in its ban. We look forward to oral argument and pressing this case forward to its ultimate conclusion,” said FPCAF President Cody J. Wisniewski, an attorney for FPC.
California Attorney General Rob Bonta is expected to file a final reply brief, after which the Court will hold oral arguments and submit the case for decision. An opinion in the case is expected this year.
