FPC Files Fifth Circuit Reply Brief in Lawsuit Challenging Federal Ban on Interstate Handgun Sales

FPC Files Fifth Circuit Reply Brief in Lawsuit Challenging Federal Ban on Interstate Handgun Sales

What: Firearms Policy Coalition (FPC) filed its reply brief with the Fifth Circuit Court of Appeals in Elite Precision Customs v. ATF, which challenges the federal laws prohibiting licensed firearm dealers from selling handguns to out-of-state buyers. FPC filed its appeal after the district court wrongly upheld the ban.

Who: FPC is joined in this case by Elite Precision Customs LLC and two individual FPC members. The plaintiffs are represented by David H. Thompson, Peter A. Patterson, and William V. Bergstrom of Cooper and Kirk, PLLC, along with Cody J. Wisniewski of FPC Action Foundation and R. Brent Cooper of Cooper & Scully, P.C.

Where: The brief was filed at the Fifth Circuit Court of Appeals, which is based in New Orleans and covers Louisiana, Mississippi, and Texas.

When: FPC’s brief was filed on May 27, 2026. The next step in the lawsuit is the court either deciding the case on the briefs or scheduling oral arguments.

Why: The ban unconstitutionally prevents peaceable people from buying handguns from stores in other states despite there being no historical justification for the law.

Quote: “The Trump Administration is doing everything it can to defend an indefensible ban that blocks peaceable Americans from buying constitutionally protected handguns outside their home state. Their argument falls apart under the Supreme Court’s binding precedent, under the relevant history, and under old-fashioned common sense. FPC is proud to continue fighting to end this immoral and unconstitutional scheme.” -FPC President Brandon Combs.
